Texas Privacy Notice

This Texas Privacy Notice (“Notice”) is specific to Texas Consumers as defined by Chapter 541 of the Texas Business and Commerce Code (“Consumers”). It provides the categories of personal data processed by Calara and its subsidiaries and affiliates engaged in the purchase, sale, and development of land and real estate (“Calara”), the purposes for processing personal data,  the categories of personal data shared with third parties, the categories of third parties with whom Calara shares personal data, and a description of the methods through which Consumers can exercise rights and make requests regarding personal data.

For the purposes of this Notice, “personal data” or “personal information” means any information that is linked or reasonably linkable to an identified or identifiable individual.  The terms “personal data” and “personal information” do not include deidentified data or publicly available information.

These categories of information include information such as name, e-mail address, postal address, government-issued identification numbers, and telephone numbers.

This category of information includes, but is not limited to, your geographic region and location, in addition to other information you provide.

Transactional Information, Commercial Information, and Consumer Information

These categories of information include information such as social security number, government-issued identification number, insurance policy information, financial information, banking information, payment card information, information about your income, debt information, asset information, telephone number, and any other information or category of information described in this Notice provided or received in contemplation of completing a communication, potential transaction, or transaction with you.

Device and Usage Information

These categories of information include information that may be automatically collected as you navigate on and through the Website.  Information, including potential personal information, collected in this way may include:

Purposes for Processing Personal Data

Depending on the nature and the reason for which personal data is provided, Calara may use personal data for commercial purposes including, but not limited to:

Consumer Privacy Requests

Consumers can submit requests to exercise Consumer rights or appeal Calara’s decision regarding a request by using the Contact Us form or by mailing a request or appeal to:

Any request or appeal must specify the right(s) the Consumer intends to exercise and contain contact information sufficient for Calara to respond to the request or appeal.

Calara is required to authenticate the identity of the party making the consumer request by verifying the identity of the Consumer through reasonable means.  Calara may request identifying information in order to authenticate a consumer request.

Calara will respond to an authenticated Consumer request no later than the forty-fifth day after the date of the receipt of the request.  We may request additional time to respond, up to an additional forty-five days, depending on the complexity and number of requests.  If we decline to take action on a request, we will inform the Consumer of the justification for declining to take action and provide information on how to appeal the decision within forty-five days.

Calara shall provide information in response to an authenticated consumer request free of charge no more than twice annually per Consumer.  If a Consumer request is manifestly unfounded, excessive, or repetitive, Calara may charge the Consumer a reasonable fee to cover the administrative costs of complying with the request or may decline to act on the request.

Categories of Personal Data Shared with Third Parties

All categories of personal information may be shared with third parties in relation to the purposes stated in this Notice, subject to applicable law and Consumer privacy rights.

Companies Affiliated with Calara

Companies that have common ownership with Calara and their agents, employees, and representatives.

Service Providers  and Contractors 

Service Providers may, among other things, help Calara communicate with you, provide marketing services, or help provide services to you as part of a communication or transaction with you.  Service Providers may also provide technology-based services and software solutions that require input of your information so Calara can communicate with you or perform its business with you. Service Providers and/or Contractors may provide services related to development of communities or other transactions and may need your information to provide services.

Financial Institutions

There may be financial institutions and payment processors involved in a transaction.  If required, your information will be shared in order to complete a transaction or contract requirements.

Parties Involved in Your Transaction 

Depending on the nature of the transaction or contract with Calara, there may be necessary third parties involved in the transaction, and Calara may share information as appropriate with those third parties.

Other Third Parties

Calara may share your information with third parties when required by law to do so or in complying with legal requests. Additional third parties may receive information when related to a purpose identified above.
